Die Exhumierung in Sancaypata: War sie wirklich ein Betrug?

Zwischen dem 27. und 29. August 2002 wurden in Sancaypata, Totos, durch die sogenannte Gemeinsame Plattform der Wahrheits- und Versöhnungskommission Exhumierungen und die Identifizierung menschlicher Überreste durchgeführt. Bei dieser Gelegenheit wies die Gemeinschaft den Gutachterbericht der ausländischen Gerichtsmediziner mit großer Empörung zurück. Diese Experten hatten behauptet, zuvor erfolgreich an Exhumierungen in Bosnien und Herzegowina, Mittelamerika, Argentinien und Chile teilgenommen zu haben. Über all die Jahre hinweg wurde dieses beispiellose, aber sehr relevante Ereignis merkwürdigerweise unter strengster Geheimhaltung gehalten. Es folgt ein ausführlicher Bericht über den Fall Sancaypata, die Präsentation des Gutachterberichts zur Identifizierung der menschlichen Überreste und die aktuellen Auswirkungen des Falls.

 

1.- Hintergrund des Falls Sancaypata - Totos:

Zwischen dem 28. und 31. Mai 1983 führten Militärstreitkräfte als Reaktion auf die Terroranschläge der Gruppe Sendero Luminoso (Leuchtender Pfad) in Ocros, Paras, Chuschi und Canchacancha gemeinsame Operationen mit den Bewohnern der betroffenen Ortschaften in der Bauerngemeinde Quispillaccta-Chuschi, ihrem Hauptort und ihren sieben Annektierungen durch. In der Folge begann ab Januar 1984 die Aufarbeitung des Falls des gewaltsamen Verschwindenlassens und der außergerichtlichen Hinrichtungen in der Gegend von Sancaypata, Totos, bezüglich des Verbleibs der folgenden fünfzehn Personen: Moises Huamán Ccallocunto, Nemesio Moreno Huamaní, Virgilio Moreno Machaca, Victorio Moreno Machaca, Víctor Espinoza Achallma, Demetrio Galindo Rocha, Francisco Huamaní Galindo, José Tomaylla Moreno, Cirilo Galindo Huamán, Cirilo Conde Galindo, Marcelino Espinoza Nuñez, Francisco Nuñez Vilca, Martín Vilca Tomaylla, Gregorio Cuello Flores und Antonio Galindo Pacotaype. Die Angehörigen ihrerseits übermittelten eine Reihe persönlicher Dokumente der Vermissten und gaben Zeugenaussagen zu den angezeigten Ereignissen ab. So wurde der Fall im November 1984 als Fall des gewaltsamen Verschwindenlassens eingereicht. Am 14. Mai 2001 berichtete eine Pressemeldung über den Fund eines mutmaßlichen Massengrabes in der Gegend von Paqpamuqu (Distrikt Totos). Während des Besuchs wurden Beschwerden der Bewohner aufgenommen, die das Vorhandensein von Gräbern in den Gegenden Sancaypata und Ccarpaccasa in Totos meldeten, wo Personen aus dem Distrikt und der Gemeinde Quispillaqta heimlich begraben worden sein sollen.

Zwischen dem 16., 17. und 18. Mai 2001 leitete die Bürgerbeauftragtenstelle (Defensoría del Pueblo) eine nicht-gerichtliche Untersuchung ein, um das Vorhandensein des Massengrabs festzustellen. Laut dem Bericht der Bürgerbeauftragtenstelle Nr. 002-2002-DP/ADDHH wurde daraufhin ein Besuch des Provinzstaatsanwalts von Cangallo, eines Mitglieds des Peruanischen Teams für Forensische Anthropologie (EPAF) und von Beauftragten der Bürgerbeauftragtenstelle koordiniert. Vor Ort wurden vorläufige Informationen über die Bestattungen in der Gegend von Sancaypata gesammelt, ein Treffen zwischen Behörden, Angehörigen der Opfer und Bewohnern des Distrikts Totos abgehalten, Ante-Mortem-Informationen über die mutmaßlichen Opfer gesammelt, Zeugenaussagen zum Fall aufgenommen und der Dokumentenbestand der Staatsanwaltschaft und der Bürgerbeauftragtenstelle überprüft.

Bei der Inspektion wurde das Vorhandensein von drei Gräbern in der Gegend von Sancaypata festgestellt. Der technische Bericht des EPAF weist jedoch auf die Schwierigkeit hin, nicht nur die fünfzehn gesuchten Personen zu finden, sondern überhaupt irgendjemanden:

„...wir halten es für möglich, eine übereinstimmende Beziehung zwischen den physischen Merkmalen des angegebenen Gebiets, den Oberflächenresten, den Erklärungen der Angehörigen und der Aussage des Zeugen zu finden. Dies führt zu der Vermutung, dass an den beschriebenen Orten ein oder mehrere Gräber mit menschlichen Überresten existieren, die zu einem Fall außergerichtlicher Hinrichtung durch die Streitkräfte gehören. Zudem liegen die Ante-Mortem-Karteikarten der Opfer vor, was den Beginn einer forensisch-anthropologischen Arbeit im Hinblick auf die Identifizierung ermöglicht.

Obwohl es vorkommen könnte, dass bei der Intervention und als Teil des Exhumierungsprozesses keine menschlichen Überreste gefunden werden, da diese geplündert worden sein könnten, gibt es ausreichend Elemente, um eine Untersuchung einzuleiten, die die Tatsache ausschließt oder bestätigt und die vorhandenen materiellen Beweise der bezeugten Ereignisse sammelt...“

Schließlich wurde die Exhumierung in der Gegend von Sancaypata, Totos, am 26. August durchgeführt, wobei menschliche Überreste gefunden wurden, denen die Codes SQ01 und SQ0201C zugewiesen wurden. Am 27. August wurden die Ausgrabungen von SQ01 und SQ0202C fortgesetzt, wobei zudem SQ0204C und angeblich SQ03 gefunden wurden (letzteres wurde weder im archäologischen Gutachten noch in der Grafik der Verteilung der entsprechenden Überreste gefunden). Daran beteiligten sich Luis Fondebride als internationaler Beobachter der Gemeinsamen Plattform der Wahrheits- und Versöhnungskommission und der Archäologe Flavio Estrada von der Staatsanwaltschaft, unterstützt von etwa sechzehn Fachleuten.

In einer in der Stadt Ayacucho eingerichteten Leichenhalle wurde zwischen dem 30. August und dem 6. September 2002 die Identifizierung der mutmaßlichen Opfer durchgeführt. Der Teil der forensisch-anthropologischen Untersuchung lag in den Händen der kolumbianischen Archäologin María Inés Barreto und der gerichtsmedizinische Teil bei Dr. Félix Briceño vom Institut für Rechtsmedizin der Staatsanwaltschaft. Dr. Briceño vermied es, seinen Gutachterbericht gemeinsam mit Frau Barreto vorzulegen – trotz deren Protesten –, da dies gegen eine vorherige Vereinbarung mit der Gemeinsamen Plattform der Wahrheits- und Versöhnungskommission verstieß.

Am Ende akzeptierten die angeblichen Angehörigen der gefundenen menschlichen Überreste die Ergebnisse der Identifizierung nicht, da sie der Meinung waren, dass diese nicht zu ihren Angehörigen gehörten. Zudem argumentierten sie, dass die Gerichtsmediziner an einem anderen Ort exhumiert hatten. Aus diesem Grund wurden Proben der individualisierten Überreste zur DNA-Identifizierung an ausländische Laboratorien geschickt, wofür eine Frist von drei Monaten festgelegt wurde. Bis zum Jahr 2003, als der Abschlussbericht der Wahrheits- und Versöhnungskommission vorgelegt wurde, war dieses finale Gutachten jedoch immer noch unbekannt.


2.- Die Versammlung zur Präsentation des Gutachterberichts über die Identifizierung der menschlichen Überreste von Sancaypata - Totos:

Die große Frage ist: Warum lehnten die Bewohner von Sancaypata das forensische Gutachten dieser „ausländischen Gerichtsmediziner“ ab, die von der Gemeinsamen Plattform der Wahrheits- und Versöhnungskommission engagiert worden waren? Die Antwort finden wir in der Versammlung zur Präsentation des Gutachterberichts über die Identifizierung der menschlichen Überreste im Fall Sancaypata im Jahr 2002, eine Woche nach der Exhumierung der Gräber. Bei dieser Gelegenheit präsentierten der Staatsanwalt Felipe Villavicencio, der argentinische Gerichtsanthropologe Luis Fondebride, die chilenische Gerichtsanthropologin Isabel Rebeco, die guatemaltekische Gerichtsanthropologin Mercedes Salado, der peruanische Archäologe Cirilo Vivanco und eine Vertreterin der Bürgerbeauftragtenstelle die Ergebnisse des Gutachtens vor den Gemeinden Quispillaqta, San Jerónimo de Pampamarca, Canchacancha und anderen. Zudem nahmen die ehemalige Kommissarin Sofía Macher und eine Quechua-Übersetzerin als Vertreterinnen der Bürgerbeauftragtenstelle teil.

Von Beginn der forensischen Untersuchung an gab es Proteste und Beschwerden der Bevölkerung bezüglich der Arbeit des Forensikerteams. Sie behaupteten, dass in anderen Gräbern exhumiert worden sei, und auf Wunsch einiger Angehöriger wurden sogar Inspektionsbesuche durchgeführt. Es setzte sich jedoch der Bericht der Spezialisten durch, die behaupteten, dass die Bedingungen für Exhumierungen in den von den Angehörigen angegebenen Gräbern nicht gegeben seien. Die Empörung erreichte ihren Höhepunkt auf dieser Versammlung, als Staatsanwalt Felipe Villavicencio ankündigte: „Einer wurde identifiziert, zwei verbleiben zur Identifizierung. Alles deutet darauf hin, dass es nicht möglich sein wird, weitere Personen aus der Liste zu identifizieren. Es gibt technische Gründe, um deren Erklärung ich Luis (Fondebride) bitten möchte, indem ich ihm das Wort erteile.“ Fondebride entwickelte seine Argumente daraufhin auf der Grundlage von drei Thesen:

 

2.1.- Es war der richtige Ort und die Identifizierung war absolut:

„Wir glauben, dass wir uns am richtigen Ort befanden, als wir an diesen drei Stellen in Sancaypata gegraben haben, entsprechend den Angaben des Zeugen, und als wir in der Untersuchung fortschritten und die Identifizierung einer der Leichen überprüften... Außerdem tauchten in diesen Gräbern Projektilhülsen von Gewehren auf, es tauchte Kleidung auf, alle Elemente tauchten auf, und außerdem haben wir einen Herrn identifiziert – dessen Namen wir gleich nennen werden –, der zur Gruppe der fünfzehn gehört. Wir haben also viele Beweise, die besagen, dass die fünfzehn zusammen getötet wurden, und die Identifizierung dieses Herrn bestätigt uns, dass die anderen Leichen nicht mehr auftauchen werden. Wir möchten uns ganz klar ausdrücken: Es gibt keine Möglichkeit, dass sich die anderen Leichen in anderen Gräbern befinden. Wir können andere Gräber untersuchen, aber das werden Gräber von anderen Angehörigen sein, nicht von Ihnen.“

Doch wie bei allen Gräbern, die bis heute untersucht wurden, erregte es auch bei dieser Gelegenheit das Erstaunen der Bewohner, dass die exhumierten Gräber viel weniger menschliche Überreste enthielten als zugesichert worden war. In diesem Fall fanden sie nur drei der fünfzehn gesuchten Überreste und konnten zu allem Überfluss nur die Identifizierung eines einzigen garantieren: die von Herrn Víctor Espinoza Achallma. Über die Quechua-Übersetzerin fragte einer der Bewohner: „Warum wurde 'nur eine Leiche' identifiziert? Vielleicht haben Sie sich geirrt und diese gehört zu anderen Angehörigen, ich möchte, dass Sie das noch einmal erklären.“ Anschließend ergänzte die Übersetzerin die Fragen der Angehörigen und bat Fondebride um Präzisierungen: Wie haben Sie identifiziert? War es durch die Kleidung, haben die Angehörigen sie wiedererkannt, oder was war der Indikator für die Aussage „dieses Opfer ist Soundso“?

 

2.2.- Die Gräber wurden durch die Umwelt und durch Raubtiere gestört:

Angesichts dieser Situation musste Fondebride ehrlich sein und all die Schwierigkeiten erklären, mit denen diese Art von Untersuchungen konfrontiert ist, und somit die Einschränkungen all ihrer Beweise, die nun nicht mehr so offensichtlich schienen:

„Es ist so schwierig, eine Leiche zu finden, weil die Leute, die sie getötet haben, sie nicht nur getötet, sondern auch versteckt haben. Aber beim Verstecken haben sie sie in der Nähe von Tieren zurückgelassen. Wenn die Leichen von Tieren gefressen werden, wenn sie sich auf einem Hügel befinden, mit dem Regen, und neunzehn Jahre vergehen, bewegen sich die Knochen, sie gehen verloren, und wir können nichts mehr tun. Es gibt keine Möglichkeit mehr zu sagen, dieser Knochen gehört zu dieser Person. Das ist das große Problem, das wir haben, deshalb haben wir nicht die fünfzehn gefunden, sondern nur fünf. Wenn das Grab gut geschützt und tief gewesen wäre, hätten wir das alles gefunden. Aber sie haben es so hinterlassen, dass die Tiere sofort anfingen zu fressen und Stücke herauszureißen. Wenn sie also nicht da sind, heißt das nicht, dass sie in einem anderen Grab sein können, denn in einem anderen Grab liegen andere Leute von anderen Angehörigen. Und wenn wir diese anderen Gräber geöffnet hätten, wüssten wir nicht, von wem sie sind, weil wir nicht für alle Gräber Zeugen haben. Wir haben Zeugen für diese, deshalb haben wir das große Problem, alle zu finden.“

So schnell wie möglich bemerkte ein Bewohner: „Aber ich stelle mir vor, dass Hunde nicht die Mehrheit auffressen können, Wasser kann sie nicht wegtragen. Es müssten doch zumindest fünf, sechs oder wenigstens zehn da sein, zehn sind schließlich viel. Wie man sagt, war das Grab etwa zwei Meter tief, das stimmt auch nicht überein, Sie haben nur fünfzig, fünfundsechzig Zentimeter gegraben. Das stimmt nicht überein. Nun gut, was sollen wir denn tun, wenn Sie gar nichts akzeptieren... dann bleibt wohl nur, diese Knochen gemeinsam mitzunehmen, aber ich bin sicher, für alle wird es das Gleiche sein.“

 

2.3.- Die Armee hatte in den Notstandsgebieten eine Boutique eingerichtet, um ihre Kleidung vor der Hinrichtung zu wechseln:

Die surrealste und amüsanteste Behauptung der Versammlung stammte jedoch vom Gerichtsmediziner Fondebride, als er das von ihnen befolgte Verfahren erklärte und die Bewohner davor warnte, sich bei der Identifizierung ihrer Angehörigen nicht auf die Kleidung zu verlassen, da das Militär ihre Kleidung vor der Hinrichtung gewechselt habe:

„Bezüglich der Kleidung: Die Gruppe der fünfzehn war auf einer Basis inhaftiert, einer Militärbasis, und es ist sehr gut möglich, dass die Kleidung der Leute gewechselt wurde. Was also passiert, ist, dass die Kleidung, von der Sie uns sagten, dass Ihr Angehöriger sie trug, nicht mit der Kleidung übereinstimmt, die am Körper war, weil sie gewechselt wurde. Vielleicht erkennen Sie also heute, wenn Sie die Kleidung sehen, ein Kleidungsstück Ihres Angehörigen wieder, aber der Körper wird nicht da sein, weil er gewechselt wurde. Vielleicht erkennen Sie eine Hose oder etwas Ähnliches, aber der Körper wird nicht da sein, nur die Kleidung.“

Diese Behauptung, mit der praktisch die Einrichtung einer Art militärischer Boutique in den Notstandsgebieten nahegelegt wird, um die Festgenommenen vor ihrer Hinrichtung einzukleiden, wurde von den Staatsanwälten und Behörden in den meisten Fällen seit den ersten von der Wahrheits- und Versöhnungskommission untersuchten Fällen (wie Sancaypata, Totos) implizit akzeptiert.

Ein Bewohner der Gemeinde, der der merkwürdigen Argumentation sehr aufmerksam folgte, warnte die „ausländischen Gerichtsmedizin-Experten“ jedoch über die Übersetzerin:

„Er erklärt, dass es einen Zeugen gibt, der diesem Massaker an den fünfzehn entkommen ist. Sie werden also fragen, ob sie die Kleidung gewechselt haben könnten oder ob diese Personen dieselbe Kleidung trugen. Das wird also auch ein Indikator sein, um zu sehen, nicht wahr? Das ist es, was sie sagen, denn wenn dem so ist, können wir nicht direkt glauben, dass sie sie gewechselt haben könnten. Wir werden mit unseren Zeugen sprechen, sagen sie, nicht wahr?“

 

2.4.- Die Lage von Sancaypata an einem Hang verhinderte die Konservierung der Überreste:

Schließlich fragt sich der argentinische Gutachter Luis Fondebride laut und antwortet sich selbst:

„Warum ist Ccarpacassa anders als Sancaypata? Ccarpacassa ist ein Gebiet, das geschützter ist, es ist flach, es ist kein Hang, daher haben sich die Leichen besser erhalten und es war einfacher, sie zu finden und zu identifizieren. Deshalb unterscheidet es sich von der Identifizierung in Sancaypata.“

Angesichts dieser ungewöhnlichen Behauptungen von Luis Fondebride erwiderte die Gemeinschaft durch einen Bewohner des Ortes – ein Gebiet, das der argentinische Gutachter Fondebride bei dieser Gelegenheit wahrscheinlich zum ersten Mal besucht hatte:

„Herr Staatsanwalt, meine Herren Gerichtsmediziner, meine Damen und Herren von der Wahrheitskommission und liebe Angehörige:

Nun, einige von uns sind wegen dieses Falls weiterhin besorgt. Wissen Sie warum? Weil wir uns diesen Ort, den wir jetzt exhumiert haben, nicht so vorstellen, dass eine Person von dort entkommen könnte; er sieht aus wie eine Pampa! Das ist er nicht. Aber auf der anderen Seite, wo wir am nächsten Tag hingegangen sind, um es mit einer Frau zu überprüfen, wurden zwei Kleidungsstücke aufgesammelt; dieser Ort war tatsächlich so, dass man sich hinunterstürzen konnte. Dadurch machen wir uns Sorgen, dass an all dem vielleicht etwas nicht stimmt, nicht wahr? Und ich möchte auch diesen Fall klären: Am nächsten Tag sind wir gegangen, um diese Gräber zu überprüfen, aber die Herren Anthropologen oder Gerichtsmediziner sagten, glaube ich, dass das keine Gräber sind. Sie sagten ganz klar: 'Das sind keine Gräber.' Letztendlich sind das aber Gräber, ich glaube, das ist eine Täuschung, nicht wahr? Das sollte nicht sein, Herr Staatsanwalt, bitte. Sie als Behörden müssen das gut untersuchen, Sie müssen die Dinge meiner Meinung nach richtig machen, nicht wahr? Beim Scharren sagten sie 'das sind keine Gräber', obwohl man es sehen würde, wenn es Gräber wären, die Steine wären weich. 'Sie sind hart, es sind keine Gräber', aber in Wirklichkeit sind das Gräber. Warum haben sie uns gesagt, dass es keine Gräber sind? Daher misstrauen wir, dass sie nur eine Person identifiziert haben, nicht wahr? Und außerdem ist dieser Teil kein Abhang, kein Ort für Schlammlawinen (Huayco), wo Regen oder Wasser etwas wegtragen könnte, nicht wahr? Es ist ein Wald, es sind Bäume, ich glaube nicht, dass sie etwas weggetragen haben...“

Am Ende wies die Gemeinschaft mit diesen Worten den Gutachterbericht zum Fall Sancaypata, Totos der Gemeinsamen Plattform der Wahrheits- und Versöhnungskommission zurück: „Wir haben diesem Team vertraut, aber im Grunde lassen sie uns in diesem Moment alle Angehörigen mit Schmerz und Frustration zurück. Warum sage ich das, Herr Staatsanwalt? Wir Bauern, wir Armen, haben vielleicht kein wissenschaftliches Wissen, und als Folge davon können wir nicht entsprechend Ihren Fragen antworten. Herr Staatsanwalt, als Vertreter der Staatsanwaltschaft bitte ich Sie, Frau Bürgerbeauftragte, ich bitte Sie, dass wieder gründlich ermittelt wird, damit wir das Gefühl haben können, zufrieden zu sein. Mehr noch, mit diesen Informationen ist es bedauerlich und schmerzhafter, dass es uns noch schlechter geht; heute werden wir hier als geistig und psychisch Kranke herausgehen. Anstatt dass wir von hier eine Erleichterung mitnehmen... vielleicht könnten wir hier etwas Gutes finden, aber das ist nicht so, alles ist das Gegenteil.“

 

The Exhumation in Sancaypata: Was It Really a Deception?

Between August 27 and 29, 2002, the exhumations and identification of human remains were carried out in Sancaypata, Totos, by the so-called Joint Platform of the Truth and Reconciliation Commission. On that occasion, the community rejected with considerable indignation the expert report of the foreign forensic specialists, who claimed to have successfully participated in exhumations carried out in Bosnia and Herzegovina, Central America, Argentina, and Chile. Throughout all these years, this unprecedented but highly relevant event has strangely been kept in absolute secrecy. Below is a detailed report on the Sancaypata case, the presentation of the expert report on the identification of the human remains, and the current repercussions of the case.

1.- Background of the Sancaypata-Totos Case:

Between May 28 and 31, 1983, military forces—in response to terrorist attacks by the Shining Path group in Ocros, Paras, Chuschi, and Canchacancha—conducted joint operations with residents of the affected locations in the peasant community of Quispillaccta-Chuschi, its main town center, and its seven annexes. As a consequence, since January 1984, the case of forced disappearances and extrajudicial executions in the area of Sancaypata, Totos, began to be formulated regarding the whereabouts of the following fifteen individuals: Moises Huamán Ccallocunto, Nemesio Moreno Huamaní, Virgilio Moreno Machaca, Victorio Moreno Machaca, Víctor Espinoza Achallma, Demetrio Galindo Rocha, Francisco Huamaní Galindo, José Tomaylla Moreno, Cirilo Galindo Huamán, Cirilo Conde Galindo, Marcelino Espinoza Nuñez, Francisco Nuñez Vilca, Martín Vilca Tomaylla, Gregorio Cuello Flores, and Antonio Galindo Pacotaype. For their part, the relatives submitted a series of personal documents of those who were missing and presented testimonial statements regarding the denounced events. Thus, in November 1984, it was filed as a case under the status of forced disappearances. On May 14, 2001, a journalistic report gave an account of the discovery of an alleged mass grave in the area of Paqpamuqu (Totos district), and during the visit, complaints were gathered from residents who stated the existence of graves in the areas of Sancaypata and Ccarpaccasa in Totos, where people from the district and the community of Quispillaqta had allegedly been clandestinely buried.

Between May 16, 17, and 18, 2001, the Ombudsman's Office initiated a non-jurisdictional investigation to determine the existence of the mass grave. Therefore, according to Ombudsman Report No. 002-2002-DP/ADDHH, a visit was coordinated involving the Mixed Provincial Prosecutor of Cangallo, a member of the Peruvian Team of Forensic Anthropology (EPAF), and commissioners from the Ombudsman's Office. On-site, preliminary information was received regarding the burials in the Sancaypata area, a meeting was held between authorities, victims' relatives, and residents of the Totos district, ante-mortem information on the alleged victims was gathered, testimonies about the case were received, and the documentary records of the Public Ministry and the Ombudsman's Office were verified.

During the inspection, the existence of three graves was verified in the area of Sancaypata. However, the technical report from EPAF expressed the difficulty of finding not only the fifteen sought individuals, but even a single one:

"..we consider that it is possible to find a matching relationship between the physical characteristics of the designated area, the surface remains, the statements of the relatives, and the testimony of the witness. This means that the described sites give rise to the presumption of the existence of one or more graves containing human remains belonging to a case of extrajudicial execution by the armed forces. Furthermore, ante-mortem files of the victims are available, which allows for the initiation of forensic anthropological work in terms of identification.

Although it could happen during the intervention and as part of the exhumation process that no human remains are found, as these might have been looted, there are sufficient elements (to) initiate an investigation that rules out or confirms the fact and gathers the existing material evidence of the witnessed events.."

Finally, the exhumation in the area of Sancaypata, Totos, took place on August 26, finding human remains to which the codes SQ01 and SQ0201C were assigned. On August 27, excavations continued for SQ01 and SQ0202C, also finding SQ0204C and allegedly SQ03 (as it has not been found in the forensic archaeological report, nor has the graphic of the distribution of the corresponding remains). Luis Fondebrider participated as an International Monitor for the Joint Platform of the Truth and Reconciliation Commission, along with archaeologist Flavio Estrada from the Public Ministry, supported by nearly sixteen professionals.

In a morgue set up in the city of Ayacucho between August 30 and September 6, 2002, the identification of the alleged victims was carried out. The forensic anthropological part of the investigation was led by Colombian archaeologist María Inés Barreto, and the forensic medical part by Dr. Félix Briceño from the Institute of Legal Medicine of the Public Ministry. Dr. Briceño avoided presenting his expert report jointly with Ms. Barreto, despite her complaints, due to failing to uphold a prior agreement with the Joint Platform of the Truth and Reconciliation Commission.

In the end, the alleged relatives of the human remains found did not accept the identification results, as they considered that the remains did not belong to them; furthermore, they argued that the forensic experts had exhumed in a different site. As a result, samples of the individualized remains were sent to laboratories abroad for DNA identification, establishing a three-month deadline. However, by the year 2003, when the final report of the Truth and Reconciliation Commission was delivered, this final ruling was still unknown.

2.- The Meeting for the Presentation of the Forensic Expert Report on the Identification of Human Remains from Sancaypata-Totos:

The big question is, why did the residents of Sancaypata reject the forensic ruling of these "foreign forensic experts" hired by the Joint Platform of the Truth and Reconciliation Commission? The answer is found in the meeting for the presentation of the expert report on the identification of human remains from the Sancaypata case in 2002, one week after the exhumation of the graves was carried out. On that occasion, the results of the expert ruling for the Sancaypata case were presented to the communities of Quispillaqta, San Jerónimo de Pampamarca, Canchacancha, and others. The presenters included prosecutor Felipe Villavicencio, Argentine forensic anthropologist Luis Fondebrider, Chilean forensic anthropologist Isabel Rebeco, Guatemalan forensic anthropologist Mercedes Salado, Peruvian archaeologist Cirilo Vivanco, and a representative from the Ombudsman's Office. Additionally, former commissioner Sofía Macher and a Quechua translator representing the Ombudsman's Office attended.

From the beginning of the forensic investigation, protests and complaints were raised by the population regarding the work of the forensic team, as they claimed that they had exhumed in other graves, and inspection visits were even carried out at the request of some relatives. However, the report of the specialists prevailed, who maintained that the conditions did not exist to perform exhumations in the graves pointed out by the relatives. Indignation reached its peak during this meeting when prosecutor Felipe Villavicencio announced: "One has been identified, two remain for identification. Everything indicates that it will not be possible to identify any others from the list. There are technical reasons that I ask Luis (Fondebrider), by giving him the floor with a gesture, to explain, please". Fondebrider then developed his arguments based on three theses:

2.1.- It was the correct location and the Identification was absolute:

"We think that when we excavated in those three locations in Sancaypata, according to what the witness said, and as we moved forward with the investigation and reviewed the identification of one of the bodies, we were in the correct place... Furthermore, shell casings from projectiles, from rifles, appeared in these graves, clothing appeared, all elements appeared, and additionally we identified a gentleman—whose name we are now going to give—who belongs to the group of fifteen. Therefore, we have a lot of evidence stating that the fifteen were killed together, and by identifying this gentleman, it confirms to us that the other bodies are not going to appear. We want to be very clear: there is no way the other bodies are in other graves. We can investigate other graves, but they will belong to other relatives, not to you."

However, as happens with all graves investigated to date, on that occasion, it caught the residents' attention that the exhumed graves contained far fewer human remains than what had been assured. In this case, they only found three of the fifteen sought human remains and, to make matters worse, they could only guarantee the identification of one of them: that of Mr. Víctor Espinoza Achallma. Through the Quechua-to-Spanish translator, one of the residents asked: "Why has 'only one body' been identified? What if you made a mistake and that one belongs to other relatives? I would like you to explain again." The translator then supplemented the relatives' questions, asking Fondebrider for clarifications: how did they identify him? Was it by his clothes? Was it because the relatives recognized him, or what was the indicator to say “this victim is so-and-so”?

2.2.- They were graves disturbed by the environment and predatory animals:

Faced with this situation, Fondebrider had to be upfront and explain all the difficulties that this type of investigation must confront, and therefore the limitations of all their evidence, which no longer seemed so indisputable:

"It is very difficult to find a body because the people who killed them did not just kill them, but they hid them; however, by hiding them, they left them near animals. When bodies are eaten by animals, when they are on a hill, with the rain, nineteen years go by, the little bones move around, they get lost, and we can no longer do anything. There is no longer any way to say this little bone corresponds to such person. That is the big problem we have; that is why we did not find the fifteen and only found five. If the grave had been well protected and deep, we would have found all of that. But they left it in a way that animals immediately started eating and tearing off pieces, so if they are not there, it does not mean they could be in another grave, because in another grave there are other people from other relatives. And if we had opened those other graves, we would not know who they belong to because we do not have witnesses for all the graves. We have witnesses for these, so that is the big problem we face in finding everyone."

With the utmost promptness, a resident remarked: "But I imagine that dogs cannot finish off the majority, nor can water carry them away. There should at least be five, six, or even ten at least; ten is a lot. According to what they say, the grave was more or less two meters deep; that doesn't match either, you have only excavated fifty, sixty-five centimeters. It doesn't match. So, well, what can we do! If you don't accept anything, then... all that's left is to take those little bones among all of us, but surely, I assure you, it will be the same for everyone."

2.3.- The Army had set up a boutique in the emergency zones to change their clothes before executing them:

However, the most surreal and hilarious statement of the meeting came from the forensic expert Fondebrider when he was explaining the procedure they had followed and warning the residents not to rely on identifying their relatives by their clothes, because the military had changed their clothes before executing them:

"In relation to the clothing, the group of fifteen was detained at a base, a military base, and it is very possible that people's clothes were changed. So, what happens is that the clothes you told us your relative had do not match what the body was wearing because they changed them. So perhaps today, if you see the clothes, you might recognize some garment that belongs to your relative, but the body will not be there because it was changed; perhaps you recognize a pair of pants or something, but the body will not be there, only the clothes."

This statement, which practically suggests the implementation of a sort of military boutique in emergency zones to dress detainees before executing them, has been implicitly accepted by prosecutors and authorities in most cases since the earliest ones investigated by the Truth and Reconciliation Commission, such as Sancaypata, Totos.

However, a community resident who was listening closely to the strange reasoning warned the "foreign forensic experts" through the translator:

"He states that there is a witness who escaped from that slaughter of the fifteen. So they are going to ask if they could have changed or if those people were in those same clothes. So, that will be an indicator to see as well, right? That is what they say, because if that is the case, we cannot just believe straight away that they could have changed them. We will talk with our witnesses, they say, right?"

2.4.- The location of Sancaypata on a slope prevented the remains from being preserved:

Finally, Argentine expert Luis Fondebrider wondered aloud and answered himself:

"Why is Ccarpacassa different from Sancaypata? Ccarpacassa is an area—the area is more protected, it is flat, it is not a slope, so the bodies were better preserved and it was much simpler to find and identify them. That is why it is different from the identification in Sancaypata."

Faced with these unusual claims by Luis Fondebrider, the community replied through a local resident, an area that the Argentine expert Fondebrider was surely visiting for the very first time on that occasion:

"Mr. Prosecutor, forensic experts, members of the Truth Commission, and relatives:

Well, some of us remain concerned about this case. Do you know why? Because as we imagine that site where we have now exhumed, it was not a place for a person to escape; it looks like a flat plain! It is not, but on the other side, where we went the next day to verify with a lady, two garments were recovered; now that site was indeed a place to throw oneself inward. With this, we worry that there is something going on here, right? And I also want to clarify this matter: the next day we went to check those graves, but the anthropologists or forensic gentlemen, I believe, said that those are not graves; they said very clearly that 'these are not graves.' Of course, at the end of the day, those are graves; I think that is a deception, isn't it? That should not be, Mr. Prosecutor, please. You as authorities must investigate it well, you must do things right, it seems to me, right?.. scraping around they said 'these are not graves,' that if they were graves, at first sight, the stones would be soft. 'They are hard, they are not graves,' but in reality, those are graves. Why did they tell us they were not graves? Because of that, we distrust that they have only identified one person, right?.. and furthermore, that area is not a cliff for rain or water to wash things away, it is not a mudslide site, right? It is a forest, it has bushy trees, I don't think they could have carried them away.."

In the end, with these words, the community rejected the expert report on the Sancaypata, Totos case from the Joint Platform of the Truth and Reconciliation Commission: "We trusted this team, but right now, all of us relatives are left with pain and frustration. Why do I say this, Mr. Prosecutor? We peasants, the poor, perhaps do not have scientific knowledge; as a consequence of that, we cannot answer according to your questions. Mr. Prosecutor, as a representative of the Public Ministry, I beg you, madam from the Ombudsman's Office, I beg you, let it go back to being thoroughly investigated so that we can feel satisfied. Moreover, with this information, it is regrettable and more painful, we are left worse off; today we are going to leave here sick, demented, and psychologically broken. Instead of leaving here with relief... we might have found something good here, but no, everything is quite the contrary."

Forensic Anthropology in Peru

Forensic Anthropology in Peru dates back to the 1990s. The first official forensic anthropologist in Peru—in this case, the first official female forensic anthropologist in Peru—is Licentiate Aidee Chávez Rodríguez from the Institute of Legal Medicine of the Public Ministry. In 1997, when I entered the Institute of Legal Medicine to complete my pre-professional internship in Forensic Anthropology, Licentiate Chávez Rodríguez was still officially the only forensic anthropologist in Peru. Later, in the year 2000, Non-Commissioned Officer and expert witness Danny Humpire became the first forensic anthropologist of the Forensic Anthropology Section in the Department of Forensic Medicine of the National Directorate of Criminalistics. Subsequently, other anthropologists, archaeologists, and odontologists would arrive, mainly at the Institute of Legal Medicine of the Public Ministry, the institution responsible for scientifically supporting the preliminary investigations of prosecutors. Some entered through positions of trust and others, as was my case and already in my capacity as a professional, through public competition.

In the year 2002, the Truth and Reconciliation Commission of Peru (CVR) had convened a group of bachelor's degree holders in archaeology, who called themselves the Peruvian Team of Forensic Anthropology (EPAF) and who had participated as expert witnesses in the case of the MRTA terrorist group annihilated by the Chavín de Huántar Command during the rescue of hostages at the Japanese Embassy in Lima. In this context, a group of sixty people, including graduates and students, mainly of Anthropology, at the Faculty of Social Sciences of the National University of San Marcos, took the initiative to form the San Marcos Forensic Anthropology Workshop. This was despite failing to secure the support of the Anthropology Students' Center (CEAN), which at that time was heavily politicized. Precisely, the Forensic Anthropology Workshop emerged as a response to the assertions of certain members of the CVR that Forensic Anthropology did not exist in Peru, and in the face of the expressed intention of Anthropology professors to split the profession into two majors: Social Anthropology and Forensic Anthropology, as they did not want to lose teaching positions.

Fortunately, the initiative coincided with the elections at the Academic Directorate of the School of Anthropology. Upon seeing the enthusiasm and reception that the Workshop aroused, the then-Director of the School, anthropologist José Vegas Pozo, made the happy decision to ingratiate himself with the Forensic Anthropology Workshop. He approved not only its execution but also our written proposal, endorsed with signatures, for the incorporation of Forensic Anthropology as an elective course in the major, and promoted taking the same measure in the Academic School of Archaeology. The Director of the School of Anthropology was re-elected, although they did not fulfill their promise to provide us with all the facilities: classrooms were difficult to obtain, and only once did we have an overhead transparency projector at our disposal.

On that occasion, professionals from the Institute of Legal Medicine of the Public Ministry and the Directorate of Criminalistics of the Ministry of the Interior participated selflessly, including forensic anthropologist Aidee Chávez Rodríguez, forensic anthropologist Danny Humpire Molina, forensic archaeologist Flavio Estrada, forensic odontologist José Vela, and forensic anthropologist Roberto Parra Chinchilla. The idea behind the Forensic Anthropology Workshop was for the students themselves to choose, from among the speakers, the next professor for the Forensic Anthropology course.

When the 2003 academic year began, the Directorate of the Professional Academic School of Anthropology at San Marcos decided, on its own accord and without the corresponding public competition, to assign the responsibility of teaching the Forensic Anthropology course to archaeologist María Inés Barreto, who was one of the assistants in the research group of the Truth and Reconciliation Commission.

It was after the four grave exhumations conducted by the Truth and Reconciliation Commission (CVR)—when the Public Ministry assumed absolute responsibility for investigations into clandestine graves and allegations of extrajudicial executions and forced disappearances dating from the era of the counter-terrorism struggle that took place in Peru between the 1980s and 2000—that Forensic Anthropology experienced a profound transformation. Needless to say, these functions always constitutionally belonged to the Public Ministry, which allowed for the consolidation of the institutionalization of Peruvian Forensic Anthropology. This implied not only the formalization of professional practice and an increase in the number of positions for anthropologists, but also the progressive, albeit slow, equipping of the essential infrastructure for scientific research work nationwide.

However, it must be recognized that the institutionalization of Forensic Anthropology, and of the other forensic sciences, was enriched by the participation of private groups of foreign and national experts in investigations regarding allegations of extrajudicial executions and forced disappearances from the counter-terrorism era between 1980 and 2000.

In the year 2003, a truly advanced document for Peruvian Forensic Anthropology was presented: the Organization and Functions Manual of the "Leonidas Avendaño Ureta" Institute of Legal Medicine. In this document, the competence of the Anthropologist in these functions is defined in Article 118, subsections b, c, e, f, h, i, l, m, n:

"The functions of the anthropologist are:

b) Locate and record anthropometric indicators on skeletal remains.

c) Describe pathology on the skeletal substrate.

e) Examine radiographic plates from an anthropological perspective.

f) Observe and handle samples for anthropological identification studies.

h) Perform somatological examinations on unidentified cadavers (John/Jane Does).

i) Practice anthropometric evaluation on living subjects and unidentified cadavers.

l) Classify common and distinct traits of human groups.

m) Develop epigenetic, morphological, and metric studies of human skeletal remains to establish comparative data for contemporary and ancestral Peruvian populations.

n) Design and implement anthropological examinations and procedures."

It was during the I International Congress of the Public Ministry - Legal Medicine, held in November 2004, that Dr. Luis Bromley Coloma, National Chief of the Institute of Legal Medicine, recognized that only since 2003 had this institution begun to develop on par with other similar and equivalent institutions worldwide, *"progressively becoming a technical, completely scientific institution providing support and advice to prosecutorial investigation."* For the first time, he presented a public balance on the exhumations of so-called clandestine graves, reporting that up to that point, 95 mass graves and 30 niches had been worked on, 102,000 skeletal remains had been studied, and out of 402 individuals, 102 identified human remains had been returned to their families.

During my appointment as a Forensic Anthropologist in the Ayacucho region—the center of investigations into extrajudicial executions, mass grave exhumations, and forced disappearances—and through the mediation of Dr. Humberto Rodríguez Pastor from the Social Sciences Area of CONCYTEC, I presented the same proposal for implementing a Forensic Anthropology course into the curriculum of the Professional School of Anthropology to Dr. Ulpiano Quispe, Dean of the Faculty of Social Sciences at the National University of San Huamanga. I held several meetings with his closest professors and students. Upon returning to the capital in Lima months later, I learned that the teaching of the forensic anthropology chair had been approved, but they had appointed a local professor who held multiple specializations, except for forensic anthropology.

Later, on the initiative of Ms. María I. Barreto Romero, the Diploma in Forensic Anthropology and Human Rights was taught at the Faculty of Social Sciences of the National University of San Marcos. Furthermore, since 2007, the Master's Degree in Forensic Anthropology and Bioarchaeology was established at the Pontifical Catholic University of Peru through the management of Dr. Sonia Guillén Oneeglio, counting with the participation of experts from the Public Ministry. As reported by journalist Paola Ugaz, this program ultimately ended amidst a scandal of plagiarized theses.

Since the beginning of 2007, a Forensic Anthropology Laboratory has been under construction in Nahuinpuquio, Huamanga-Ayacucho. I was the first to request and justify the need for this facility through the article "Scientific Intelligence in Human Identification Matters" in the Journal of the Public Ministry of Ayacucho in May 2004. This occurred when I was deployed, in my capacity as a professional anthropologist, to the Legal Medical Division of Ayacucho, which led to me being awarded Resolution of the Senior Dean Prosecutor of Ayacucho No. 287-2004-MP-FSDDJ-A, granting Recognition and Commendation for my Institutional Identification and Academic Merits (Ayacucho Fiscal District). The forensic anthropology laboratory is projected to become the most modern in Latin America.

Currently, Peruvian forensic anthropology is going through its most decisive stage: the possibility of consolidating its scientific character in the practice of the profession, or that of atomizing into new and minuscule anthropologies to which others prematurely want to grant autonomy. Likewise, in my capacity as a Forensic Anthropologist in the Lima Centro Region of the Institute of Legal Medicine—deployed to the department of Ayacucho with the Commission for the Exhumation of Clandestine Graves, Extrajudicial Executions, and Enforced Disappearances (2004)—I was very surprised to observe that, from the investigations carried out by the experts of the Truth and Reconciliation Commission to those led by the Specialized Forensic Team of the Public Prosecutor's Office, the reconstruction of the original position of the human remains before being exhumed from clandestine graves is not performed. Furthermore, methods and techniques that a group of foreign forensic experts have internationalized are applied; these were implemented based on the anthropological characteristics of urban American and European populations, and the finding of clothing is not validated within the identification process. In Peru, for instance, the consequences of using parameters and ranges from American and European populations for the identification of Andean individuals have been highly regrettable, given that several sessions for the presentation of expert reports ended with the rejection, by the victims' own relatives, of the human remains supposedly identified, as occurred in Sancaypata and Cayara. 

In the document Practical Guide for the Recovery and Analysis of Human Remains (2017), it is acknowledged that out of the estimated 70,000 to 100,000 victims by the Truth and Reconciliation Commission, only 2,125 individuals were identified, and they were barely able to return the remains to 1,989 families.

Evidently, the final word will belong to the new generation of young Peruvian forensic anthropologists. They must decide whether they will settle for accumulating diplomas in Forensic Anthropology and applying what others have researched, or—what is more intelligent and honest—whether they will specialize in each of the broad and fascinating topics that comprise Forensic Anthropology and dedicate themselves to publishing what they themselves have rigorously and faithfully researched.

Fake associations of forensic anthropologists in Peru

The justice system and the academic sphere are currently facing a silent but devastating threat: the alarming emergence of individuals who, under the guise of private associations of forensic anthropologists or in a personal capacity, act as syndicates with ideological and criminal purposes against the Peruvian State. They offer specialized, high-level expert witness services and training without possessing the scientific, ethical, or legal backing required by the Peruvian legal system.

The Proliferation of "Super-Experts" and Academic Fraud in Anonymity

The informal and illegal market of forensic science has shaped two recurring criminal modalities.

On one hand, there is the appearance of individuals who lack a professional degree in anthropology or the mandatory professional registration and active status, yet style themselves as "super-experts". They claim to be capable of issuing expert reports in any specialty—ranging from ballistics and crime scenes to physical anthropology—flagrantly violating the exclusive scientific competencies of each discipline.

On the other hand, private institutions and associations are proliferating, offering diploma courses and specialization training in forensic anthropology while keeping the names of their instructors strictly anonymous until enrollment. The reason for this concealment is evident: those teaching the classes are not professional anthropologists, lack scientific production and forensic experience, or are absolute unknowns in the academic community. This type of pseudo-training not only defrauds students but also introduces erroneous concepts and bad practices that irreversibly damage forensic education in the country.

Criminal Anthropologist Experts and Ties to Terrorism

The problem worsens exponentially with allegations that some of these groups and networks are composed of specialists with police records. Some even possess a history of arrest warrants arising from their involvement in illicit activities during the period of the fight against terrorism. These individuals have allegedly played a crucial role in accusations against members of the armed forces for extrajudicial executions and forced disappearances.

In effect, the participation of these specialists faces severe questioning due to an alarming and suspicious scientific and technical deficiency, as well as elementary methodological errors in the identification, recovery, and analysis of human remains. The lack of an ethical filter and rigorous oversight allows these elements to infiltrate not only official expert practice but also private or defense counsel work. Operating collectively as syndicates, they present themselves as qualified interlocutors before the authorities, when in reality they only seek to continue their ideological project against the Peruvian State and their highly lucrative activities in human rights issues.

Currently, the situation reaches scandalous proportions when analyzing the performance of certain official experts. In their capacity as public servants in high-profile court cases, they face serious public allegations of generic fraud, abuse of authority, usurpation of functions, and even the presentation of forged training certificates.

Likewise, there is open functional misconduct and a lack of ethics: State servants acting as defense experts or sponsoring associations against the very public institutions for which they provide services, or exploiting their access to official information to favor private interests. This conduct not only violates elementary ethical principles but directly breaches explicit legal prohibitions regarding dual salary perception, conflicts of interest, and post-employment restrictions within the Peruvian public administration.

The Peruvian Legal Framework: Explicit Violations of Current Regulations

The actions of these fake associations and infringing experts directly clash with constitutional norms, special laws, and institutional codes that regulate professional practice in Peru:

1. The Illegal Exercise of a Profession and the Mandatory Professional Registration

In Peru, a forensic anthropologist expert is strictly required to hold a professional degree as an anthropologist, and to be registered and active within the Professional College of Anthropologists of Peru. Those who perform expert functions or teach forensic coursework without meeting these requirements commit offenses criminalized under the Penal Code.

Article 363 of the Peruvian Penal Code textually establishes:

"He who practices a profession without meeting the required legal conditions shall be punished with a restriction of liberty of no less than two and no more than four years".

Furthermore, Article 273 of the 2004 Criminal Procedure Code (CPP) is conclusive regarding the conditions an expert must meet:

"The expert must possess a professional degree in the matter and be duly registered in their professional college, unless the science, technique, or art is not regulated or there are no professionals available in the locality".

In the case of graduates in social anthropology, they should only be authorized to conduct socio-cultural expert assessments. Given that anthropology is a fully regulated profession in the country, the use of fake degrees or the simulation of competencies constitutes a clear criminal violation.

2. Direct Violation of Law N° 31564 (Law for the Prevention of Conflicts of Interest)

The actions of public servants who participate as defense experts against the State itself or who incur conflicts of interest are severely sanctioned.

Law N° 31564—*the Law regulating obligations and restrictions applicable to public servants in order to prevent conflicts of interest*—and its respective regulations explicitly prohibit personnel serving the state apparatus from intervening in matters where the institution they belong to is a procedural party or holds opposing interests. Acting as a defense expert against one's own institution violates the principle of probity outlined in Article 7 of Law N° 27815 (Law of the Code of Ethics of the Public Function), which mandates that public servants must act with rectitude and honesty, striving to satisfy the general interest and rejecting any personal profit or advantage.

3. Technical Deficiency vs. Rules of Scientific Admissibility

The expert reports issued by these "super-experts" or false specialists lack valid probative value and are routinely dismissed during the intermediate control stages of criminal proceedings due to their evident lack of reliability.

Article 178 of the Criminal Procedure Code stipulates that an expert report must mandatorily contain:

"The description of the situation or state of facts, whether person or thing, upon which the expert assessment was made; the detailed exposition of what was practiced and its result; and the conclusions reached in accordance with the principles of their science, technique, or art".

When an expert acts with "high scientific deficiency," fakes certifications, or lacks the appropriate training to validate the international methods and techniques they use within the Peruvian population, they violate the guarantees of due process. This exposes judicial operators to grave judicial errors and revictimizes those affected.

Conclusion

Forensic anthropology in Peru cannot become a playing field for front associations with ideological and criminal aims against the Peruvian State, academic frauds, or sanctioned professionals with conflicts of interest who commercialize justice.

The oversight institutions of the justice system have an imperative obligation to supervise and rigorously apply the criminal and administrative sanctions demanded by Peruvian laws. Defending the rigor of forensic science is, ultimately, defending truth, the rights of the population, and the memory of the victims.

Die Suche nach Orientierungspunkten: Identifizierung durch Bildüberlagerung im nationalen Justizsystem

In dieser Untersuchung werden die rechtlichen, wissenschaftlichen und technischen Voraussetzungen für die Anwendung der Methode der Identifizierung durch Überlagerung von Bildern im nationalen Justizsystem auf der Grundlage der peruanischen Erfahrungen ermittelt.

Gegenwärting sind in Justizsystemen wie dem peruanischen die Anklagen der Staatsanwälte nicht sehr kohärent und die gerichtlichen Verurteilunge recht subjektiv, was auf die unterschiedlichen Schlussfolgerungen in den von den offiziellen Sarchverständigen vorgelegten Berichten zur Bildidentifizierung zurückzuführen ist, was vor allem auf das Fehlen eines institutionellen Regelungsrahmens, eines Protokolls und offizieller Verfahrensleitlinien zurückzuführen ist.

In diesem Sinne wird dieses erste Protokoll vorgeschlagen, basierend auf den metrischen Merkmalen der Bildquelität und anthropologische Merkmale, für die Identifizierung durch Überlagerung von Bildern mit einem umfassenden Leitfaden von Verfahren, für die Anwendung, hier und jetzt, in der Justiz.

The Search for Landmarks: Identification by Imagen Overlay in the National Justice System

In the 21 st century the methods of human identification and criminal investigation have had a revolutionary development in the world, which has caused the maximum use of photography, audios and videos, as evidential means. In the countries, the methods of overlaying images in the identification of persons acussed has been one of the most required by the national justice, however, there is no regulatory framework the regulates their legitimate use of this method in the judicial system, nor that it defines profile of the responsible expert or a guide of application of the said method:

"Of the proposals for the application of the method of identification by superimposition for images the European scientific community turns out to be the most objetive, rigorous transparent. In principle, because in countries like the United States forensic sciences are still in a stage of pending governmental investigation due to massive complaints about the indiscriminate use of empirical criteria and even accusations of racial bias described in detail in the report Stregthening Forensic Science in the United States: A Path Forward (2009) by the U.S. National Research Council and the report Forensic Science Criminal Courts: Ensuring Scientify Validity of Feature-Comparison Methods ( 2016 ) by the Government's Council of Advisors on Science and Technology"

Likewise, this book demonstrates the problems of applying the method and, in addition, the following question is answered: what a basic conditions for anthropological identification through the method of superimposing images?.

Mario Vargas Llosa y la Antropologìa Forense





Cuando se anunció el otorgamiento del Premio Nobel de Literatura 2010 al escritor peruano Mario Vargas Llosa, se resaltó, entre otras cualidades, su "cartografía de las estructuras del poder, sus afiladas imágenes de la resistencia, rebelión y derrota del individuo". Al respecto, cabe recordar que en un ámbito tan sensible como son los derechos humanos, Vargas Llosa también ha sabido abordar temas tan especializados como la antropología forense, con el aval y la experiencia de haber presidido una Comisión Investigadora , durante el segundo gobierno del ex presidente peruano Fernando Belaunde Terry, a propósito del asesinato de los periodistas en Uchuraccay, Ayacucho y ser designado, por el actual gobierno, Presidente del Museo de la Memoria Colectiva de los Derechos Humanos.

Con ocasión de la investigación Operación Che: Historia de una Mentira de Estado de los periodistas Maite Rico y Bertrand de la Grange, publicó en el diario El País de España, el 10 de marzo de 2007, la reseña crítica titulada Los Huesos del Che, que en realidad es una introducción al trabajo de estos polémicos periodistas. Vargas Llosa repara en los argumentos de Rico y de la Grange tres observaciones que todo antropólogo forense debe tener siempre presente:

.
1.- La importancia de las declaraciones y del testimonio de los pobladores en las investigaciones. Es inadmisible que, en América Latina, los casos concluyan con versiones de los testigos absolutamente opuestas a las conclusiones de las Comisiones investigadoras. Vargas Llosa lo sabe porque en la Comisión que él presidió en el caso Uchuraccay, la comunidad mantuvo una posición coherente y unanime sobre los sucesos. Sin embargo, por alguna extraña razón, y curiosamente, en la actualidad, a pesar del surgimiento de dizque expertos y del alto desarrollo científico y tecnológico de las ciencias forenses, la mayoría de las investigaciones terminan en medio de escándalos y severamente cuestionadas por objeciones sencillas pero precisas de la población. Al parecer a estos forenses el protagonismo y la soberbia los han llevado a ignorar el elemento más relevante de una investigación : la versión del testigo.

2.- La transparencia que debe existir en toda investigación que esté orientada a la elaboración de conclusiones contundentes no puede escatimar utilizar todos los medios que estén a su alcance para evitar suspicacias. En la investigación sobre los restos del Che, se presenta una situación muy familiar a los casos que actualmente se registran en América Latina, se trata de la búsqueda de 23 entierros conteniendo los restos óseos de 36 guerrilleros que perecieron en 1967 en diversas circunstancias y combates en Bolivia. En el transcurso se tiene que evaluar 50 versiones de sitios donde habían sido enterrados los guerrilleros, se encuentran los restos óseos de 31, la mayoría muy fragmentados, en donde, al final, son encontrados los restos del Che y seis de sus acompañantes, siendo los restos del jefe guerrillero los últimos en ser desenterrados. Ante esta situación, el médico forense Jorge Gónzalez, entonces director del Instituto de Medicina Legal de La Habana y quien dirigió la investigación, se había comprometido a someter los restos a la prueba del ADN, sin embargo, sorpresivamente, lo reconsideró y desistió. Esta decisión fue respaldada por otro de los participantes, Alejandro Inchaurregui, nada menos que un discípulo del forense estadounidense Clyde Snow y que 1984 fundó el Equipo Argentino de Antropología Forense ( EAAF ).

3.- La objetividad científica y la neutralidad ética que debe caracterizar al profesional forense no puede olvidar que, independientemente a sus simpatías o animadversiones, su misión es la identificación del cadáver o los restos óseos. En este sentido, Vargas Llosa ilustra esta disyuntiva con el significado de la persona del Che : "No importa que los historiadores serios muestren, en trabajos exhaustivos, que el Che Guevara real, de carne y hueso, estaba muy lejos de ser ese dechado de virtudes milicianas y éticas. Que fue valiente, si, pero también sanguinario, capaz de fusilar a decenas de personas sin el menor escrúpulo, y que, desde el punto de vista militar, sus fracasos y errores fueron bastante más numerosos que sus éxitos".

Lamentablemente, estas tres deficiencias que Vargas Llosa observa, con gran inteligencia y lucidez, en las investigaciones a propósito del asesinato del Che Guevara, se siguen presentado como una alarmante constante en la mayoría de los casos en América Latina.

La Exhumación en Sancaypata : ¿Fue Realmente un Engaño?

Entre el 27 y 29 de agosto de 2002, se realizaron las exhumaciones e identificación de restos humanos en Sancaypata, Totos por la denominada Plataforma Conjunta de la Comisión de la Verdad y Reconciliación. En aquella oportunidad, la comunidad rechazó con bastante indignación el informe pericial de los expertos forenses extranjeros, quienes afirmaban haber participado exitosamente en las exhumaciones realizadas en Bosnia y Herzegovina, Centroamérica, Argentina y Chile. Durante todos estos años, este acontecimiento inédito pero muy relevante, extrañamente ha sido mantenido en la más absoluta reserva. A continuación un informe pormenorizado sobre el caso Sancaypata, la presentación del informe pericial sobre la identificación de los restos humanos y las repercusiones actuales del caso.





1.- Antecedentes del Caso Sancaypata- Totos :




Entre el 28 y 31 de mayo de 1983 fuerzas militares en respuesta a los ataques senderistas en Ocros, Paras, Chuschi y Canchacancha realizan operaciones conjuntas con los pobladores de las localidades afectadas en la comunidad campesina de Quispillaccta- Chuschi, su principal centro poblado y sus siete anexos. Como consecuencia, desde enero de 1984, comienza a formularse el caso de las desapariciones forzadas y ejecuciones extrajudiciales en el paraje de Sancaypata, Totos, respecto al paradero de las siguientes quince personas : Moises Huamán Ccallocunto, Nemesio Moreno Huamaní, Virgilio Moreno Machaca, Victorio Moreno Machaca, Víctor Espinoza Achallma, Demetrio Galindo Rocha, Francisco Huamaní Galindo, José Tomaylla Moreno, Cirilo Galindo Huamán, Cirilo Conde Galindo, Marcelino Espinoza Nuñez, Francisco Nuñez Vilca, Martín Vilca Tomaylla, Gregorio Cuello Flores y Antonio Galindo Pacotaype. Por su parte, los familiares remitieron una serie de documentos personales de quienes se encontraban en condición de desaparecidos y presentaron declaraciones testimoniales sobre los hechos denunciados. Así, en noviembre de 1984 se presenta como caso en condición de desapariciones forzadas. El 14 de mayo de 2001, una información periodística daba cuenta del hallazgo de una presunta fosa común en el paraje de Paqpamuqu ( distrito de Totos ), y durante la visita se recoge las denuncias de los pobladores quienes manifestaban la existencia de fosas en los parajes de Sancaypata y Ccarpaccasa en Totos, donde habrìan sido enterradas clandestinamente personas del distrito y de la comunidad de Quispillaqta.




Entre los días 16, 17 y 18 de mayo de 2001, la Defensoría del Pueblo inició una investigación no jurisdiccional para determinar la existencia de la fosa común, por lo cual, según el Informe Defensorial nro. 002-2002-DP/ADDHH, se coordinó una visita del Fiscal Provincial Mixto de Cangallo, un miembro del Equipo Peruano de Antropología Forense ( EPAF ) y comisionados de la Defensoría del Pueblo. En el lugar, se recibió información preliminar sobre los enterramientos en el paraje de Sancaypata, se realizó una reunión entre autoridades y familiares de las víctimas y pobladores del distrito de Totos, se recogió información premortem sobre las presuntas víctimas, se recibieron testimonios sobre el caso y se verificó el acervo documental del Ministerio Público y la Defensoría del Pueblo.

En la inspección se constató la existencia de tres fosas en el paraje de Sancaypata. Sin embargo, el informe técnico del EPAF expresa la dificultad de encontrar no sólo a las quince personas buscadas, sino siquiera a alguna :

"..consideramos que es posible encontrar una relación coincidente entre las características físicas del área señalada, los restos superficiales, las declaraciones de los familiares y el testimonio del testigo. Esto hace que los sitios descritos, den lugar a la presunción de la existencia de una o más fosas con restos humanos pertenecientes a un caso de ejecución extrajudicial por parte de las fuerzas armadas. Se cuenta además con las fichas antemortem de las víctimas, lo que permite el inicio de un trabajo antropológico forense en términos de la identificación.

Si bien podría suceder que en la intervención y como parte del proceso de exhumación no se encontraran restos humanos, pues estos pudieron haber sido saqueados, hay los elementos suficientes (para) iniciar una investigación que descarte o confirme el hecho y que reuna las evidencias materiales existentes de los hechos testimoniados.."

Por fin, la exhumación en el paraje de Sancaypata, Totos se realizó el 26 de agosto, encontrándose restos humanos, a los cuales se les asignaron los códigos : SQ01, SQ0201C y el 27 de agosto se continuaron las excavaciones de los SQ01, SQ0202C, hallándose además, el SQ0204C y supuestamente el SQ03, pues no lo he encontrado en el informe pericial arqueológico en la Defensoría del Pueblo, ni el gráfico de la distribución de los restos correspondientes ), y donde participaron Luis Fondebride, como Monitor Internacional de la Plataforma Conjunta de la Comisión de la Verdad y Reconciliación, y el licenciado Flavio Estrada, del Ministerio Público, apoyados por cerca de dieciseis profesionales.

En una morgue instalada en la ciudad de Ayacucho entre el 30 de agosto y el 06 de setiembre de 2002, se realizó la identificación de las presuntas víctimas. La parte de la investigación antropológica forense estuvo a cargo de la arqueóloga colombiana María Inés Barreto y la médico forense por el Dr. Félix Briceño, del Instituto de Medicina Legal del Ministerio Público, quien evitò presentar su informe pericial conjuntamente con la señora Barreto, a pesar de los reclamos de esta, por faltar a un acuerdo previo con la Plataforma Conjunta de la Comisión de la Verdad y Reconciliación.

Al final, los supuestos familiares de los restos humanos encontrados, no aceptaron los resultados de la identificación, pues consideraban que no les pertenecían, además argumentaron que los forenses habían exhumado en otro sitio. Por lo cual, se enviaron a laboratorios en el extranjero muestras de los restos individualizados para la identificación por ADN, estableciendo tres meses como plazo. Sin embargo, hasta el año 2003, cuando se entregó el informe final de la Comisión de la Verdad y Reconciliación, este dictamen final todavía se desconocía.

2.- La Reunión para la Presentación del Informe Pericial sobre la Identificación de los Restos Humanos de Sancaypata- Totos :

.


La gran pregunta es ¿por qué rechazaron los pobladores de Sancaypata el dictamen forense de estos "expertos forenses extranjeros" contratados por la Plataforma Conjunta de la Comisión de la Verdad y de la Reconciliación?. La respuesta la encontramos en la reunión para la presentación del informe pericial sobre la identificación de los restos humanos del caso Sancaypata el año 2002, una semana después de realizada la exhumación de las fosas. En aquella oportunidad, presentaron los resultados del dictamen pericial del caso Sancaypata ante la comunidad de Quispillaqta, San Jerónimo de Pampamarca, Canchacancha y otras, el fiscal Felipe Villavicencio, el antropólogo forense de nacionalidad argentina Luis Fondebride, la antropóloga forense de nacionalidad chilena Isabel Rebeco, la antropóloga forense de nacionalidad guatemalteca Mercedes Salado, el arqueólogo peruano Cirilo Vivanco y una representante de la Defensoría del Pueblo. Además, asistió la ex comisionada Sofía Macher y una traductora del quechua representando a la Defensoría del Pueblo.

Desde el comienzo de la investigación forense, se presentaron protestas y quejas de la población con relación a la labor del equipo forense, pues afirmaban que habían exhumado en otras fosas e incluso, a pedido de algunos familiares, se llegaron a realizar visitas de inspección. Sin embargo, prevaleció el informe de los especialistas, quienes sostuvieron que no existían las condiciones para realizar las exhumaciones en las fosas que señalaban los familiares. La indignación llegó a su máxima expresión, en esta reunión, cuando el fiscal Felipe Villavicencio anunció : "Se han identificado uno, quedan dos para la identificación. Todo indica que no va a ser posible idiidiidentificar a ninguno más de la lista. Hay razones técnicas que pido, por favor, a Luis ( Fondebride), dándole la palabra con la mano, explicarlas". Entonces, Fondebride desarrolló sus argumentos en base a tres tesis :

2.1.- Era el lugar correcto y la Identificación fue absoluta :

"Nosotros pensamos queee cuando excavamos en esos tres lugares en Sancaypata, de acuerdo a lo que decía el testigo y fuimos avanzando en la investigación y revisamos la identificación de uno de los cuerpos que estábamos en el lugar correcto... Además, en estas fosas aparecieron casquillos de proyectil, de fusil, aparecieron vestimentas, aparecieron todos los elementos y además identificamos a un señor, que ahora vamos a dar el nombre del señor identificado, que corresponde al grupo de los quince, entonces tenemos mucha evidencia que dice que a los quince los mataron juntos y, al identificar a este señor, nos confirma eso que los otros cuerpos, ya no van a aparecer. Queremos ser bien claros, no hay forma que los otros cuerpos están en otras fosas. Podemos investigar otras fosas, pero van a ser de otros familiares, no de ustedes"

Pero, como ocurre con todas las fosas que hasta la fecha se han investigado, en esa oportunidad, llamó la atención de los pobladores que las fosas exhumadas contengan mucho menos restos humanos de los que se aseguraba y, en este caso, sólo encontraran tres de los quince restos humanos buscados y, para colmo, sólo pudieran garantizar la identificación de uno de ellos : el del señor Víctor Espinoza Achallma. A través de la traductora del quechua al español, uno de los pobladores preguntó : "¿por qué se ha identificado "sólo un cuerpo"?. De repente se han equivocado y ese es de los otros familiares, quisiera que vuelvan a explicar", luego la traductora complementa las interrogantes de los familiares, pidiendo precisiones a Fondebride : ¿cómo han identificado?, si fue por su ropa, si fue por que los familiares reconocieron o ¿cuál fue el indicador para decir “esta víctima es tal"?.

2.2.- Eran fosas disturbadas por el ambiente y por los animales depredadores :

Ante esta situación, Fondebride tiene que sincerarse y explicar todas las dificultades que este tipo de investigaciones tiene que afrontar, y por tanto las limitaciones de todas sus pruebas, que ya no parecían ser tan evidentes :

"Es tan difícil encontrar un cuerpo porque la gente que lo mató, no solamente lo mató, sino que se escondió, pero al esconderlos lo dejó cerca de los animales, y cuando los cuerpo son comidos por los animales, cuando están en un cerro, con la lluvia, pasan diecinueve años, los huesitos se van moviendo, se van perdiendo ya no podemos hacer nada, ya no hay forma de decir este huesito corresponde a tal persona. Ese es el problema grande que tenemos, por eso no encontramos los quince y encontramos solamente cinco. Si hubiéramos si la fosa hubiera estado bien protegida y hubiera sido profundo, hubiéramos encontrado todo eso. Pero la dejaron de una manera que los animales enseguida empezaron a comer y arrancar pedazos, entonces si no están ahí, no quiere decir que pueden estar en otra fosa, porque en otra fosa hay otra gente de otros familiares. Y si hubiéramos abierto esas otras fosas no tendri no sabríamos de quien son, porque no tenemos testigos para todas las fosas. Tenemos testigos para estos, por eso es el problema grande que tenemos de encontrar a todos".

Con la mayor prontitud posible, un poblador observó: "Pero imagino de que mayoría no pueden acabar perros pues, no pueden llevar agua. Por lo menos debe haber cinco, seis o diez siquiera pues, mucho pues diez. Según dicen la fosa eran más o menos dos metros, tampoco no coincide, solamente ustedes han excavado cincuenta, sesenticinco centímetros. No coincide. Entonces, bueno pues, ¡qué vamos a hacer pues nosotros!, si ya ustedes no aceptan nada, entonces.. no queda llevar esos huesitos entre todos, pero seguramente, yo aseguro, para todos será igual"


2.3.- El Ejército había instalado una boutique en las zonas de emergencia para cambiarles la ropa antes de ejecutarlos :

Sin embargo, la afirmación más surrealista e hilarante de la reunión la tuvo el forense Fondebride, cuando explicaba el procedimiento que habían seguido y advertir, a los pobladores, que no se confiaran en identificar a sus familiares mediante la ropa, pues los militares les habían cambiado la ropa antes de ejecutarlos :

"En relación con la vestimenta, el grupo de los quince estuvo detenido en una base, una base militar y es muy posible que a la gente se le cambia la ropa. Entonces, lo que pasa es que la ropa que ustedes nos dijeron que tenía su familiar no coincide con lo que estaba vestido en cuerpo, porque se la cambiaron. Entonces quizás ustedes hoy, si ven la ropa pueden reconocer alguna prenda que sea de su familiar, pero el cuerpo no va a estar, porque se cambió, quizás ustedes reconocen una un pantalón o algo, pero el cuerpo no va a estar solamente la ropa".

Esta afirmación, donde practicamente se sugiere la implementación de una especie de boutique militar en las zonas en emergencia, para vestir a los detenidos antes de ejecutarlos, ha sido aceptada implicitamente por los fiscales y autoridades, en la mayoría de los casos desde los primeros que alcanzó a investigar la Comisión de la Verdad y Reconciliación, como Sancaypata, Totos.

Sin embargo, un poblador de la comunidad muy atento a la extraña argumentación, le advirtió a los "expertos forenses extranjeros" a través de la traductora:

"Él manifiesta que hay un testigo que ha escapado de esa matanza de los quince. Entonces van a preguntar si pudieron haberse cambiado o han estado con esa misma ropa esas personas. Entonces, eso será un indicador para también ver ¿no?. Eso es lo que dicen, porque de ser así nosotros no podemos creer de frente que hayan podido cambiar. Conversaremos con nuestros testigos, dicen ellos ¿no?”.

2.4.- La Ubicación de Sancaypata en una pendiente impidió que los restos se conservaran :

Finalmente, el perito argentino Luis Fondebride se pregunta en voz alta y se responde:

"¿Por qué es diferente Ccarpacassa a Sancaypata?. Ccarpacassa es una zona, la zona está más protegida, está planito, no es una pendiente, entonces se conservaron mejor los cuerpos y fue más, más sencillo poder encontrarlos y identificarlos. Por eso es diferente que la identificación de Sancaypata"

Ante estas insólitas afirmaciones de Luis Fondebride, la comunidad replicó a través de un poblador del lugar, zona que, seguramente, el perito argentino Fondebride recién en esa oportunidad había visitado por primera vez:

"Señor fiscal, señores forenses, señores de la Comisión de la Verdad y señores familiares :

Bueno a algunos de nosotros nos sigue preocupando este caso. ¿Sabes por qué?. Porque como imaginamos ese sitio donde que ahora hemos exhumado, no era como pa escaparse una persona, ¡ se ve como una pampa !, no es, pero al otro lado que el día siguiente hemos ido para verificar con una señora se ha recogido pues dos prendas, eso si ese sitio era como para aventarse hacia adentro. Con esto nosotros nos preocupamos que en esto de repente hay algo ¿no? y quiero aclarar también este caso de que el día siguiente hemos ido a comprobar esas fosas, pero los señores antropólogos o forenses creo, dijeron que esos no son fosas, dijeron bien claro que "estos no son fosas". Claro, al final de cuenta esos son fosas, eso creo que es un engaño ¿no?, eso no debe se señor fiscal, por favor. Ustedes como autoridades deben investigarlo bien, deben hacer las cosas bien me parece ¿no?.. raspando dijeron que "estos no son fosas", que a la vista serían si se fueran fosas, serían a la vista las piedras serían suavecitas. "Están duros, no son fosas", pero en realidad eso son fosas, ¿por qué nos dijeron que no eran fosas?. Por ahí nosotros nos desconfiamos que solamente han identificado a una persona ¿no?.. y además esa parte pa que lleve lluvia o agua no es un barranco, no es un sitio de huayco ¿no?, es un bosque, es un árboles bosquejos, no creo que hayan llevado.."

Al final, con éstas palabras la comunidad rechazó el informe pericial del caso Sancaypata, Totos de la Plataforma Conjunta de la Comisión de la Verdad y Reconciliación : "Nosotros hemos confiado en este equipo, pero en sí en estos momentos a todos los familiares nos dejan con dolor, frustrados. ¿Por qué digo esto señor fiscal?. Nosotros los campesinos, los pobres, de repente no tenemos conocimientos científica, a consecuencia de ellos nosotros no podemos responder de acuerdo a sus preguntas. Señor fiscal, como representante del Ministerio Público, ruego, señora Defensoría del Pueblo, ruego a usted, que sea di vuelta a investigar exhaustivamente y, así, pensar que podemos quedar conforme, más aún, con esta información, es lamentable y más dolorosa que quedamos más peor, hoy día vamos a salir enfermos dementales y psicológicos. En vez de salir de acá un alivio... de repente podemos encontrar algo bueno acá, pero no es, todo es contrario".

3.- Las Repercusiones Actuales del Caso Sancaypata- Totos :



Desde la presentación del Informe Final de la Comisión de la Verdad y Reconciliación, diversas personalidades, procedentes de todos los sectores sociales, han realizado severos cuestionamientos a sus argumentaciones y conclusiones, desde el actual Vicepresidente de la República, Luis Giampietri Rojas, el Presidente del Consejo Por la Paz Francisco Diez-Canseco, hasta prestigiosos intelectuales de la izquierda peruana como Raúl Wiener y Agustín Haya de la Torre.



Asimismo, desde enero de 2002, cuando se iniciaron las exhumaciones de las fosas clandestinas y las investigaciones sobre las denuncias de ejecuciones extrajudiciales por la violencia política durante la década pasada, desde entonces, y en sólo siete años, se han acumulado gravísimas denuncias respecto a estas investigaciones :

1.- Queja del personal del Ministerio Público contra los miembros del Equipo Peruano de Antropología Forense ( EPAF ) por falta de profesionalismo y, a través del Dr. Juan Guzmán Aparco, Fiscal Superior Decano del Distrito Judicial de Ayacucho, se expresa la preocupación de la comunidad ayacuchana al conocer que éstos arqueólogos propuestos por la Comisión de la Verdad y Reconciliación solamente ostentaban el grado académico de bachiller.

2.- Denuncia de los supuestos familiares de diversos casos, quienes no han aceptado las labores de identificación de los restos efectuadas por los miembros del Instituto de Medicina Legal del Ministerio Público y, en cambio, pidieron la participación del EPAF como peritos de parte.

3.- Denuncia pública del Equipo Peruano de Antropología Forense ( EPAF ) de las labores de exhumación de fosas realizadas por el Instituto de Medicina Legal del Ministerio Público, calificándolas de "exhumaciones masivas" y afirmando que éstas importantes investigaciones estaban siendo realizadas por personal sin experiencia.

4.- Con fecha 21 de enero de 2007, se publicó en la página web del Ministerio Público, el documento Consultoría para la Evaluación del Trabajo de Exhumaciones realizada por el licenciado en arqueología Francisco De León y el abogado Leonardo Gabriel Filippini, con el apoyo del PNUD-ASDI, y en el cual se observa entre las principales conclusiones :

"1. Evaluación del Patrón de Investigación utilizada por la Fiscalía Especializada. La información analizada por esta consultoría sugiere que la investigación de las graves violaciones a los derechos humanos ocurridas en el Perú no ha seguido, ni sigue un patrón de pesquisa definido con claridad. Si bien la labor de la Comisión por la Verdad y Reconciliación organizó la información e impulsó la investigación de algunos casos conforme a ciertos parámetros, la práctica posterior ha generado que las actividades de investigación no siguieran un rumbo totalmente claro"-21-22.

5.- Al salir Luis Bromley de la Jefatura de Medicina Legal, el Equipo Peruano de Antropología Forense ( EPAF ) realizó una solicitud pública de una auditoria de los trabajos de exhumación de fosas realizados por el Instituto de Medicina Legal del Ministerio Público. El directivo del EPAF, José Pablo Baraybar llegó a calificar de desastre el balance sobre la identificación y entrega de los restos humanos a los supuestos familiares de los desaparecidos, presentado por Bromley, a fines del año 2007 y tras cuatro años de gestión.

En cuanto al caso Sancaypata-Totos es paradigmático dentro de las investigaciones realizadas por la CVR, y se puede constatar que en general "la metodología" empleada siguió siendo utilizada desde la fecha hasta la actualidad por Medicina Legal del Ministerio Público y, por tanto, continuaron las mismas y hasta mayores deficiencias, que hacen muy cuestionables las conclusiones. Entre las principales tenemos :

- Desde mi punto de vista, la exhumación en Sancaypata, es una prueba que en la mayoría de estos casos investigados el valor criminalístico respecto a la naturaleza o causa del suceso y después de más de veinte años, por lo menos, debe ser materia de debate por especialistas y no de políticos, al ser fosas disturbadas por la misma población, los animales, las lluvias, etc. Algo importante, desde las exhumaciones de la Comisión de la Verdad y Reconciliación, los informes periciales adolecen de la descripción del procedimiento de la reconstrucción de la posición original de los restos óseos, que precise con rigor la pertenencia y correspondencia de los huesos. No vaya a ser que el mismo "experto" esté disturbando los restos humanos.

- Actualmente, se están utilizando parámetros y rangos antropológicos de poblaciones norteamericanas y europeas en la identificación de estas poblaciones andinas de la época de la violencia política.

Por ejemplo, desde las investigaciones de la Plataforma Conjunya de la CVR, para la estimación de la estatura se emplean los rangos de Genovés y Trotter y Gleser . En el caso de Santiago Genovés sus parámetros corresponden al trabajo paleoantropológico Proportionality of Long Bones and Their Relation to Stature Among Mesoamericans, publicado en 1967 en American Journal of Roentgenoly, volumen 26, páginas 67-77, el cual es una investigación con restos óseos de indios americanos prehispánicos y su aplicación en restos óseos contemporáneos para pericias es francamente risible. Con respecto a éstas estimaciones de las estaturas con estándares internacionalizados, el mismo Genovés, anecdoticamente narra cómo se demostró que los restos de Texepan, que se hallaban en el Laboratorio de Antropología Física del Museo del Antiguo Palacio del Arzobispado, no pertenecían a un hombre alto y mayor, el Padre de Mesoamérica, sino a una mujer joven y bajita, lo cual resultó en un escándalo nacional y medio mundial. En el caso de Trotter y Gleser, corresponden a los restos de jóvenes norteamericanos que murieron en la guerra contra Vietnam.

Respecto a los rangos para la estimación del sexo, se emplearon y se están utilizando los parámetros morfológicos de Buikstra y Ubelaker ( 1994 ), el armazón pélvico de Hoyme-Iscan ( 1989 ) y el cráneo con su mandíbula de Krogman-Iscan ( 1986 ) y, con relación a la estimación de la edad, se han elegido los cambios de desarrollo y crecimiento óseo de Krogman-Iscan ( 1986 ), la formación y erupción dental de Ubelaker ( 1989 ), la transparencia radicular de Lamendin ( 1992 ) y los cambios en la sínfisis púbica de Suchey-Brooks ( 1990 ), Gilbert y MacKern ( 1973 ). ¿Qué de científico puede tener la indistinta aplicación de estos procedimientos, de esta ensalada de parámetros de todas las razas, edades y épocas, y según la particular conveniencia del perito, en la identificación de poblaciones andinas del tiempo de la violencia política en el Perú?. Como señala el prestigioso D.R. Brothwell en Desenterrando Huesos, FCE, México 1987 : "Lo primero que hay que tener en cuenta es que el valor de determinadas características varía según el grupo humano que se esté estudiando. Así, el grado de desarrollo supraorbital, que en Europa sirve para identificar los huesos procedentes de varones, puede encontrarse en un cierto número de mujeres entre los aborígenes de Australia.."

De cualquier manera, es importante precisar que : sí es posible identificar algunos restos humanos, aunque no en la magnitud que se especula y, por tanto, es justo que el Estado Peruano proceda a la reparación individual de los deudos de los restos verdaderamente identificados, pero también debe advertirse algo fundamental: que la identificación es sólo una etapa de la investigación forense y, por si mismas, las fosas encontradas no son suficientes para formular acusaciones fiscales, ni mucho menos condenar a alguien.

Finalmente, el 06 de noviembre de 2008, se ha presentado en el Congreso de la República el Proyecto de Ley nº2848-2008-CR: "Proyecto de Ley de Creación de Comisión Ad Hoc encargada de proponer al Señor Presidente de la República la Concesión de Indulto, Conmutación de la Pena y Derecho de Gracia a los Miembros de las Fuerzas Armadas y de la Policia Nacional del Perú que han participado en el Proceso de Lucha por la Paz", seguramente persuadidos por las graves irregularidades en estas investigaciones y que compromete a importantes instituciones públicas.

Considero que la aprobación del Proyecto de Ley nº2848-2008-CR, independientemente de su objetivo, y en conformidad con los artículos 7 y 8, va a permitir conocer cuáles han sido los verdaderos alcances y las limitaciones de estas investigaciones forenses y determinar responsabilidades funcionales y hasta penales.

Este informe fue presentado al Consejo Por la Paz, a solicitud del Dr. Francisco Diez Canseco Távara, y analizado en una entrevista el 29 de agosto por Perú TV, Canal 23 en la frecuencia UHF. y otras retransmisoras a nivel nacional y por el cable. Además, fue difundida en una nota de prensa por el diario Correo el día martes 01 de setiembre.
